Why it matters

China registers trademarks to whoever files first

Using your brand abroad does not reserve it in China. Your factory, packaging suppliers and freight agents all see your brand, and any of them can file it first.

An NNN agreement binds the factory that signs it. A China trademark protects your brand against everyone else. Most brands manufacturing in China need both, and each has its own deadline: the NNN before you share your designs, the trademark as soon as the brand name is settled.

What's in the package

Supplier check pack

Legal identity, related companies, and whether you are dealing with a factory or a trading company, from public records.

03

China trademark filing

Clearance search, class and subclass selection, and the application filed with CNIPA by our law firm. One mark in one class, official fee included.

Questions brand owners ask

Before you share your brand with a Chinese factory

Usually about 9 to 12 months from filing to registration, if no one opposes the application. The filing date matters more than the registration date: China registers trademarks to whoever files first, so your place in line is fixed the day the application is filed with CNIPA.
Usually yes. Your factory, packaging suppliers and freight agents all see your brand. If someone else registers it in China first, they can use that registration to challenge goods bearing your brand at export, and recovering the mark later costs far more than filing now. A China trademark protects the brand against everyone; an NNN agreement binds only the factory that signs it.
There are still routes. Under Article 15 of the PRC Trademark Law, a mark filed by someone who knew it through a business relationship with you, such as your manufacturer, can be opposed during the 3-month publication period, or invalidated after registration, generally within five years. Filings made in bad faith without intent to use can be invalidated under Articles 4 and 44. These matters need evidence of the relationship and are quoted separately by the attorney.
If you sell in China, or expect to, yes. Chinese buyers, platforms and distributors will give your brand a Chinese name whether you choose one or not, and an unregistered Chinese name can be registered by someone else. If you only manufacture in China, the English mark comes first. A Chinese-character mark is a separate application and is quoted separately.
No. Amazon Brand Registry relies on a trademark in the country of the marketplace you sell on, such as a US trademark for amazon.com. A China trademark does a different job: it protects the brand where the goods are made and shipped from.
Yes, if you file in China within six months of your first filing in another Paris Convention country, the China application can claim that earlier date as its priority date under Article 25 of the PRC Trademark Law. After six months, the China filing date applies.
A preliminary search of the CNIPA register for identical and similar marks, for one mark in up to two classes, done by hand by a PRC attorney. You get a short email within 1 business day: clear, some risk, or already filed by someone else, and whether the filer looks connected to your supplier. It is not a legal opinion on whether your mark can be registered. Results are sent by email only.
